1. Introduction

These Terms and Conditions ("Terms") govern your use of the OpenPlainField website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

OpenPlainField ("we," "us," or "our") is a professional tour operator registered in the United Kingdom (Registration No: 80112287) with our principal place of business at 4 Harris Garden Port Scotthaven, W1G 9PZ.

2. Definitions

In these Terms, unless the context requires otherwise:

  • "Booking" means the reservation of a tour or travel service through our website, by phone, email, or in person.
  • "Client," "you," or "your" refers to the person or entity making a booking with us.
  • "Services" means all travel arrangements, tours, accommodations, and other services provided or arranged by OpenPlainField.
  • "Tour" means a guided travel experience arranged by OpenPlainField.
  • "Website" means the OpenPlainField website at www.openplainfield.media and all its subdomains.

3. Booking and Payment Terms

3.1 Booking Confirmation

A booking is confirmed when we issue a booking confirmation and receive the required deposit or full payment. All bookings are subject to availability at the time of confirmation.

3.2 Deposit Requirements

A non-refundable deposit of 25% of the total tour price is required at the time of booking to secure your reservation. For bookings made within 60 days of departure, full payment is required at the time of booking.

3.3 Final Payment

Final payment is due 60 days before the departure date. If final payment is not received by the due date, we reserve the right to cancel the booking and retain the deposit.

3.4 Payment Methods

We accept payment by credit card, debit card, bank transfer, and other specified payment methods. All payments must be made in the currency specified in your booking confirmation.

3.5 Price Guarantee

Once your booking is confirmed with a deposit, the price of your tour is guaranteed against surcharges, except for increases due to government actions, currency fluctuations exceeding 3%, or fuel surcharges imposed by transportation providers.

4. Cancellation and Changes

4.1 Cancellation by Client

If you cancel your booking, the following cancellation fees apply:

  • More than 60 days before departure: Deposit amount (25% of tour price)
  • 60-45 days before departure: 50% of total tour price
  • 44-30 days before departure: 75% of total tour price
  • Less than 30 days before departure or no-show: 100% of total tour price

All cancellations must be received in writing. The cancellation date is the date on which we receive your written notice.

4.2 Changes by Client

If you request changes to your booking after confirmation, we will make reasonable efforts to accommodate your request, subject to availability and any additional costs. An administration fee of £50 per change applies to all booking modifications.

4.3 Cancellation by OpenPlainField

We reserve the right to cancel a tour for any reason before departure. If we cancel your tour, you can either:

  • Receive a full refund of all monies paid; or
  • Transfer to an alternative tour of comparable standard, if available (with price adjustment if necessary)

If a tour is canceled due to force majeure (see Section 11), different terms may apply.

4.4 Changes by OpenPlainField

We reserve the right to make minor changes to tour itineraries when necessary. Minor changes include alteration of transportation, accommodation, or service providers of similar quality. For significant changes, we will inform you as soon as reasonably possible and offer you the option to:

  • Accept the proposed changes;
  • Transfer to an alternative tour of comparable standard, if available; or
  • Cancel your booking and receive a full refund of all monies paid

5. Travel Insurance

Travel insurance is mandatory for all clients booking tours with OpenPlainField. Your insurance must cover personal injury, medical expenses, repatriation, emergency evacuation, trip cancellation, loss of luggage, and other risks specific to your tour.

Proof of adequate insurance coverage may be requested prior to departure. We reserve the right to refuse your participation on a tour if you have not arranged suitable insurance coverage.

6. Passports, Visas, and Health Requirements

You are responsible for ensuring that you meet all entry requirements for the countries you are visiting, including valid passports, visas, and health/vaccination certificates. Your passport must be valid for at least six months beyond the end date of your tour.

We can provide general information about passport, visa, and health requirements, but you should confirm specific requirements with the relevant embassies or consulates. We accept no liability if you are refused entry to a country because you do not have the correct documentation.

7. Tour Participation and Conduct

7.1 Fitness and Health Requirements

Our tours may require a minimum level of fitness and health. You must inform us of any medical conditions, disabilities, or special needs that may affect your participation before booking. We reserve the right to decline a booking if we believe a client's health or fitness level is unsuitable for a tour.

7.2 Age Restrictions

Clients under 18 years of age must be accompanied by an adult. Some tours may have specific age restrictions due to the nature of activities involved.

7.3 Client Behavior

You agree to act with reasonable prudence and consideration for other tour participants and to follow any reasonable instructions or guidelines provided by our staff or tour guides. If your behavior causes danger, distress, or annoyance to others, damages property, or interferes with the operation of the tour, we reserve the right to terminate your participation without refund.

8. Liability and Responsibility

8.1 Our Liability to You

We accept responsibility for ensuring that the services we provide are delivered with reasonable skill and care. If any part of your tour is not provided as described, we will pay appropriate compensation if this has affected your enjoyment of the tour, except where:

  • The failure is attributable to you or a member of your party;
  • The failure is attributable to a third party unconnected with the provision of services;
  • The failure is due to force majeure or circumstances beyond our control;
  • The failure results from circumstances that could not have been foreseen even with all due care.

8.2 Limitation of Liability

Our liability to you is limited to a maximum of three times the cost of your tour, except in cases of death, personal injury, or illness where we or our suppliers are proven to have been negligent.

We cannot accept liability for any loss or damage to personal possessions or travel documents, or for indirect, consequential, or economic losses.

8.3 Independent Suppliers

We act as an agent for various independent suppliers that provide accommodation, transportation, and other services. These suppliers are independent contractors, and we have no control over their actions or omissions. We accept no responsibility for any act or omission of any supplier or for any loss, damage, injury, expense, delay, or irregularity arising from the supply of such services.

9. Special Requests and Complaints

9.1 Special Requests

We will pass any reasonable special requests to the relevant suppliers, but we cannot guarantee that requests will be met. Failure to meet special requests does not constitute a breach of contract on our part.

9.2 Complaints

If you have a complaint during your tour, you must inform our tour guide or local representative immediately to allow us the opportunity to resolve the issue on the spot. If the issue is not resolved to your satisfaction, you must submit a written complaint to us within 28 days of the end of your tour. Failure to follow this procedure may affect your right to claim compensation.

10. Intellectual Property and Content

All content on our website, including text, images, logos, and software, is the property of OpenPlainField or our content suppliers and is protected by international copyright laws. You may not reproduce, modify, distribute, or republish any content from our website without our prior written consent.

11. Force Majeure

We cannot accept liability or pay compensation where the performance or prompt performance of our obligations is prevented or affected by "force majeure." Force majeure includes any event that we or our suppliers could not foresee or avoid, such as war, threat of war, civil strife, natural or nuclear disaster, industrial dispute, terrorist activity, fire, adverse weather conditions, epidemics, pandemics, technical or maintenance problems with transport, or other circumstances beyond our control.

12. Data Protection and Privacy

We are committed to protecting your privacy. The personal information you provide when booking with us is used to process your booking and provide your tour. We may share your information with our suppliers and other third parties necessary for the fulfillment of your travel arrangements.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

14. Amendments to Terms

We reserve the right to amend these Terms at any time. The Terms in force at the time of your booking will apply to your tour. Any changes to these Terms will be posted on our website, and you should check regularly for updates.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
